ASHI Listserv Rules and Terms of Use Agreement

By joining and using the ASHI listserv, you agree that you have read and will follow the rules established for this peer discussion group in this ASHI Listserv Rules and Terms of Use Agreement (“Agreement”). You also agree to reserve listserv discussions for messages relating to an appropriate ASHI topic.

As with any community, there are rules governing behavior on the ASHI listserv. For instance, violating the antitrust laws, libeling others, and selling or marketing products or services are not permissible. Please take a moment to acquaint yourself with these important rules. ASHI reserves the right to suspend or terminate participation on the ASHI listserv for users who violate the terms of this Agreement.

• The discussions on the listservs are meant to stimulate conversation, not to create contention. Do not challenge or attack others. Let others have their say, just as you may, and do not dominate the discussions.
• Do not post commercial messages. Advertising products, services, classes and groups, even if they are free, is not permitted on the ASHI listserv. Product and service information in your signature line is generally acceptable, but you must limit your signature block to no more than 12 lines including spaces. Contact people directly, not through the listserv, with products and services that you believe would help them.
• Use caution when discussing products or service providers. Information posted on the listserv is available for all to see, and comments are subject to libel, slander, and antitrust laws. Sharing grievances about suppliers, companies and individuals with which or whom you have done business and had a bad experience is not permitted.
• Messages may not be posted if they encourage or facilitate an agreement that either expressly or impliedly leads to price fixing, a boycott of another's business, or other conduct intended to restrict competition. Messages that encourage or facilitate an agreement about the following subjects are inappropriate: prices, discounts, or terms or conditions of sale; salaries; profits, profit margins, or cost data; market shares, sales territories, or markets; allocation of customers or territories; or selection, rejection, or termination of customers or suppliers.
• All defamatory, abusive, profane, threatening or otherwise offensive postings are strictly prohibited. Do not post anything in a listserv message that you would not want the world to see or that you would not want anyone to know came from you.
• Do not post any information or other material protected by copyright without the permission of the copyright owner. ASHI and other listserv participants have the right to reproduce postings to the listserv.
• Refrain from sending one-line responses such as “thanks.” These messages are more appropriately sent as personal replies off the list.
• Respond offline to requests for a personal reply.
• Refrain from making duplicate posts.

ASHI accepts no responsibility for the opinions and information posted on any listserv by others. ASHI disclaims all warranties with regard to information posted on the listserv, whether posted by ASHI or any third party. In no event shall ASHI be liable for any damages whatsoever, including without limitation special, indirect, or consequential damages, arising out of or in connection with the use or performance of any information posted on the ASHI listserv.

Participant Representations

By posting material, the posting party warrants and represents that he or she owns the copyright with respect to such material or has received permission to post the material from the copyright owner. In addition, the posting party grants ASHI and users of the listserv the nonexclusive right and license to display, copy, publish, distribute, transmit, print, and use such information or other material.

Participant Release and Indemnification

Listserv participants agree that ASHI will not be responsible for any indirect, consequential, special or punitive damages or losses participants may incur in connection with the ASHI listserv or any of the data or other materials transmitted through or residing on the ASHI listserv, even if ASHI has been advised of the possibility of such damage or loss. In addition, each participant agrees to defend, indemnify and hold ASHI, its officers, directors and agents harmless from and against any and all claims, proceedings damages, injuries, liabilities, losses, costs and expenses (including attorneys’ fees) relating to any acts or omissions by such participant or materials or information transmitted by such participant in connection with the ASHI listserv, which acts, omissions or materials lead wholly or partially to claims against ASHI, its officers, directors or agents by other listserv participants or third parties.

ASHI does not customarily monitor its listserv for inappropriate postings and does not on its own undertake editorial control of postings. However, in the event that any inappropriate posting is brought to ASHI's attention, it will take all appropriate action, including without limitation removal of the inappropriate posting. ASHI also reserves the right to put its listserv in a moderated mode such that participant postings will be reviewed for propriety prior to actual posting to the listserv; participants hereby acknowledge and agree that they have no right to make a posting to the ASHI listserv and they hereby release ASHI from any liability in connection with a decision to post or not to post any message.

ASHI reserves the right to terminate or suspend access to its listserv by any participant who does not comply with this Agreement.

Participants agree that the law of the State of New Jersey in the United States of America will apply to all matters relating to this Agreement and to the ASHI listserv. In addition, participants agree and consent that, if there is ever any legal action against ASHI arising out of the ASHI listserv, the state and federal courts located in the State of New Jersey, USA, will have exclusive jurisdiction and be the exclusive venue for any such legal action. Each listserv participant agrees that the courts in that jurisdiction will have the right to exercise personal jurisdiction over such participant in connection with any claim involving one of such participant’s postings to the ASHI listserv.

This Agreement is the entire understanding between each ASHI listserv participant and ASHI regarding such participant’s relationship to the ASHI listserv. If ASHI fails to notify any participant of any violations of this Agreement, this will not mean that ASHI cannot notify such participant of future violations of any part of this Agreement.

ASHI reserves the right to modify this Agreement at any time in its sole discretion.

Acknowledgment and Acceptance

I have read and understand the foregoing ASHI Listserv Rules and Terms of Use Agreement and agree to use the ASHI listserv only in compliance with the terms of this Agreement.
